Agreement to terms

By installing or using the Checklist Design Figma plugin ("Plugin") or any associated web services at checklist.design ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Plugin or Services.

These Terms constitute a legally binding agreement between you and Checklist Design Pty Ltd (ABN 93 686 494 726), a company registered in Australia ("we," "us," or "our").

Description of services

Checklist Design provides:

  • A website and Figma plugin of curated design checklists to support your design process

  • An AI quality checker that analyses selected Figma frames and returns design feedback (the "AI Checker")

  • A free tier offering a limited number of AI Checker analyses per month

  • Paid credit packs that provide additional AI Checker analyses beyond the free tier

Accounts

To access certain features — including the AI Checker and paid credits — you must create an account by providing your email address. You will receive a magic link to authenticate; no password is required.

You are responsible for keeping your account secure. You must not share your account with others or allow others to access your account. Notify us immediately at hello@checklist.design if you suspect unauthorised access.

Free tier

Registered users receive a set number of free AI Checker analyses per calendar month ("Free Tier"). The current allocation is stated in the plugin and on our website and may be updated from time to time.

  • Free Tier usage is tracked server-side, tied to your Figma account, and resets automatically at the start of each calendar month

  • Free Tier analyses cannot be carried over between months

  • We reserve the right to adjust the Free Tier allocation with reasonable notice

Paid credits

Purchasing credits

Additional AI Checker analyses beyond the Free Tier are available for purchase as credit packs through our website. Purchases are processed by Polar, our payment provider. By purchasing credits, you agree to Polar's terms and any applicable fees.

Credit terms

  • Credits are non-transferable and linked to your Checklist Design account

  • Credits do not expire (unless otherwise stated at time of purchase)

  • Credits have no cash value and cannot be refunded once used

  • Credit balances are not transferable between accounts

Refunds

All credit pack purchases are final and non-refundable. By completing a purchase, you acknowledge that you are buying a digital service and that no refund will be issued once payment is processed, except where required by applicable law (including the Australian Consumer Law where a consumer guarantee applies).

We encourage you to review the available credit pack options carefully before purchasing. If you have questions before buying, contact us at hello@checklist.design.

Pricing

Credit pack prices are displayed at time of purchase. All prices are in USD unless otherwise stated. We reserve the right to change pricing with reasonable notice. Purchases made before a price change are not affected.

Use of the AI checker

By submitting a frame for AI analysis, you represent that:

  • You have the right to share the content of that frame (e.g. you own it, or have appropriate permissions)

  • The frame does not contain confidential or sensitive information you are not authorised to share with third-party AI services

You acknowledge that frame images are transmitted to Anthropic's Claude API for processing and are not stored by us after the analysis is complete. See our Privacy Policy for details.

AI Checker results are generated by AI and are provided for informational purposes only. They do not constitute professional design advice. We make no warranty as to the accuracy, completeness, or fitness for purpose of AI-generated feedback.

Use licence

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Plugin and Services for your personal or professional design work.

You may:

  • Use the Plugin within your Figma files for personal or commercial design projects

  • Use and share checklist content in your design outputs with appropriate attribution

  • Submit frames you own or have rights to for AI analysis

You may not:

  • Reverse engineer, decompile, or disassemble the Plugin

  • Attempt to circumvent usage limits or free tier restrictions

  • Use automated tools to abuse the AI Checker (e.g. bulk automated submissions)

  • Sell, resell, sublicence, or redistribute the Plugin or credits

  • Use the Plugin in a way that violates Figma's Terms of Service or Developer Policy

  • Use the Services for any unlawful purpose or in violation of any applicable laws

Intellectual property

All checklist content, plugin code, branding, and related materials are owned by Checklist Design Pty Ltd or our licensors and are protected by intellectual property laws. Nothing in these Terms grants you ownership of any of our intellectual property.

You retain ownership of any designs you create. By submitting feedback or support requests, you grant us a non-exclusive, royalty-free licence to use that information to improve our services.

Termination

We may suspend or terminate your access to the Plugin or Services immediately and without prior notice if we reasonably believe you have breached these Terms, engaged in fraudulent or illegal activity, or if required to do so by law.

You may terminate your account at any time by contacting us at hello@checklist.design. Termination does not entitle you to a refund of unused credits except as required by applicable law.

The following sections survive termination: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law.

Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Checklist Design Pty Ltd and its directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of or access to the Plugin or Services; (b) your breach of these Terms; or (c) your violation of any applicable law or the rights of any third party.

This indemnification obligation does not apply to the extent that a claim arises from our own negligence or wilful misconduct.

Availability and changes

We aim to keep the Plugin and Services available but do not guarantee uninterrupted access. We may update, modify, or discontinue features at any time. Where we make material changes, we will provide reasonable notice.

We reserve the right to suspend or terminate access to the Services for users who violate these Terms.

Disclaimers

THE PLUGIN AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED.

AI CHECKER RESULTS ARE GENERATED BY AN AI MODEL AND ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY. THEY DO NOT CONSTITUTE PROFESSIONAL ADVICE OF ANY KIND.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHECKLIST DESIGN PTY LTD AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLUGIN OR SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR AUD $100, WHICHEVER IS GREATER.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable Australian consumer law.

Governing law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

Australian consumer law

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.

Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, by email. Continued use of the Plugin or Services after changes constitutes acceptance of the updated Terms.

Severability and waiver

If any provision of these Terms is found by a court to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms at any time does not constitute a waiver of that right or provision.

Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Checklist Design Pty Ltd regarding your use of the Plugin and Services, and supersede any prior agreements between us on that subject matter.
